DAC Beachcroft, Steve Turner and BHR Emma Fuller of DAC Beachcroft has posted on LinkedIn a report from one of her colleagues about an appeal decision on hire rates. It is copied below: “There are lots of ‘firsts’ for the team at the moment. Yesterday was our first ‘virtual’ Appeal. The matter of Bunting v Zurich Insurance PLC was heard in front of Pepperall J by video conference. At first instance, the claim for hire was reduced from £26,591.28 to £3,989.14 based on our basic hire rate evidence. The Judgment was appealed by the Claimant on lengthy grounds concerning our rates evidence. I am pleased to confirm the appeal was dismissed, with the Judge providing some useful comments in relation to the quality of evidence expected in credit hire claims. He also confirmed questions of deposit are irrelevant in a case where the Claimant is not asserting impecuniosity. Full alert and Judgment will follow shortly.
