We understand that the majority of applications for pre action disclosure in respect of potentially impecunious claimants are being issued out of Cardiff County Court.
One member has reported that they are successfully defending those applications in most courts, except for Cardiff. This probably explains why the applications are being issued in Cardiff!
Based on previous comments on this matter, the prospects for applications heard in Cardiff are not good and so the suggestion is that those members facing these pre action disclosure applications should apply to have the case transferred to the Claimant’s home court to improve the potential outcome.
