All DQs must now be completed within 28 days of receipt the Defence, and before 4.00pm on that day, otherwise the claim will be dismissed on the DCP, and an application will be required. Any paper DQs then filed will be returned.
Helpfully, the DCP have not stated what type of application is required.
The matter has been referred back to Judge Rennison as the change is contradicted by the relevant CPR provision. The suggestion is that, pending a response, and in circumstances where the DQ is not filed in time, an application for relief should be made until the DCP have given a clear response.
